Environmental Solutions (arborist) will be here at the end of October to work on the trees that are not Arecas. Richard at 808 Maintenance has been performing a lot of repairs throughout the complex, so if there are any urgent issues that need to be addressed, please contact Michelle Zeigler, Resident Manager, right away. Unit Registration Forms are available online or you can contact the resident manager and receive it via email. HOLIDAY SEASON COMMUNITY REMINDERS: Holiday Decorations: Christmas and/or New Year decorations between the dates of December 2nd, 2022 and January 10th, 2023. We will be decorating various palm trees and the guard shack for Christmas this year, our very own winter wonderland. MODIFICATIONS OF COMMON ELEMENTS: The below references to our Declaration and By-laws are what the Board has advised on numerous occasions regarding modifications to common elements are to be vetted through the resident manager and the Board of Directors before making any said repair or modification. The lanais and front entrance decks are never allowed modifications. Any damage due to the unauthorized modifications will be paid for by the owner of the unit. If you currently have tile or flooring on top of the cement deck, you are at risk for significant costs if water intrudes into existing structures below the surface of the flooring. By-Laws of the Association of Apartment Owners of Kaimala Marina, “Article V Obligations of Apartment Owners, Section 2. Maintenance of Apartments, Every apartment owner shall at his own expense at all times well and substantially repair, maintain, amend and keep his apartment, including without limitation all internal installations therein such as water, electricity, gas, telephone, sewer, sanitation, air conditioning, lights and all other fixtures and accessories belonging to such apartment and the interior decorated or finished surfaces of all walls, floors and ceilings of such apartment, with all necessary reparations and amendments whatsoever in good order and condition except as otherwise provided by law or the Declaration, and shall be liable for all loss or damage whatsoever caused by his failure to perform any such work diligently, and in case of such failure after reasonable notice to perform shall reimburse to the Association promptly on demand all expenses incurred by it in performing any such work authorized by the Board of Directors or the Managing Agent. Every apartment owner and occupant shall reimburse the Association promptly on demand all expenses incurred by it in repairing or replacing any uninsured loss or damage to the common elements or any furniture, furnishings and equipment therefor caused by such owner or occupant or any person under either of them and shall give prompt notice to the Managing Agent of any such loss or damage or other defect in the project when discovered.” “Section 3. Use of Project, (o) Nothing shall be allowed, done or kept in any apartments or common elements of the project which would overload or impair the floors, walls, or roofs thereof, or cause any increase in the ordinary premium rates or the cancellation or invalidation of any insurance thereon maintained by or for the Association.” Declaration of Horizontal Property Regime of Kaimala Marina, “F. Administration of Project, (g) Not erect or place on the Project any building or structure, including fences and walls, nor make additions or structural alterations to, or exterior changes of, any common elements of the Project, nor place or maintain thereon any signs, posters or bills whatsoever, except in accordance with plans and specifications, including detailed plot plan, prepared by a licensed architect if so required by the trustees, first approved in writing by the trustees and also approved by a majority of apartment owners (or such larger percentage as required by law or this Declaration) including all owners of apartments thereby directly affected, as determined by the Board, and complete any such improvements diligently after the commencement thereof.” KAYAK RAFFLE The Board of Directors have scheduled a raffle to be taken place on Wednesday, October 19th at 7:45 p.m., or at the conclusion of budget meeting. The winner will have seven (7) days to produce a permit in order to take possession of the kayak, and then they will need to send the resident manager a picture of the kayak’s location on the marina. PARKING LOT SAFETY Please be aware, for the safety of all, that our parking lot is also a pedestrian walkway and drive accordingly. Drivers sometimes move at a speed appropriate for a roadway, so be aware and watch for neighbors, people walking their dogs, and especially children. Additionally, the parking lot is not an appropriate place for children to play, please ensure your children are aware, especially children on riding their scooters, etc. WEBSITE The complex website is now current and has been updated to ensure the latest information and initiatives are provided as we move on them. Kaimalamarina@org.com has every form or contact number that you will need. MARINA SAFETY Please be aware, for the safety of all, that children should be accompanied by a parent or guardian AT ALL TIMES while their children are on the marina, and especially while engaged in fishing of any kind, which could be a potential trip-and-fall hazard that the Kaimala Marina AOAO would not be responsible for in any way.
